Former garda to be sentenced for stealing from pensioner and colleagues

A former garda will be sentenced tomorrow for theft and fraud charges.

David Foran, 30, was dismissed from An Garda Síochána when he was arrested on December 3, 2009 for the theft of €2,000 from an 82-year-old woman in Phibsboro. The incident occurred between October 10 and October 17.

Foran also stole money from his colleagues at Fitzgibbon Garda Station which was collected for social events, including a Chritsmas party.

Foran used the money to pay off his debts.

Foran’s family has paid back the money that was stolen but will still have to face the courts tomorrow for sentencing.

Shots fired at house in Suncroft, Kildare

There were reports of shots being fired last night in the Church View Estate of Suncroft, Kildare.

This is the second time this month an incident such as this has occurred,

The Leinster Leader also reports an incident which happened on May 8 where a hooded  man walked up to the front of the house and fired shots at the front door.

Four arrested following cash in transit robbery at St Mary’s Place, Dublin 7

Three men and one woman in their 20s have been arrested in connection with a cash in transit robbery on February 1 of this year.

The vehicle was robbed at St Mary’s Place, Dublin 7 at 8.05 am. A silver car pulled up alongside the van as it was in traffic and two men wearing balaclavas smashed the windows of the van and made their escape with and undisclosed amount of cash.

The group are currently detained at Bridewell, Pearse Street, Raheny and Mountjoy Garda Stations under section 4 of the Criminal Justice Act, 1984.

Man jailed after DNA recovered from grenade

A man whose DNA was found on a grenade which was thrown at a house containing four elderly people has been jailed for three and a half years.

The bomb exploded outside the house causing extensive damage to the exterior and three cars that were parked in the driveway. The residents were unhurt.

Michael McCabe, 23, was charged with handling explosives after his DNA was found on the grenade pin which was discarded near the scene.

The court heard the attack was part of a feud involving criminals “significantly higher up the ladder” than McCabe. One of these criminals is now dead while the other is not in the country. McCabe became involved because of a family relationship to one of them.

McCabe of Buttercup Avenue, Coolock pleaded guilty at Dublin Circuit Criminal Court to possession of explosives at Edenmore Park, Raheny on May 21, 2009.

Judge Martin Nolan said a jail sentence could not be avoided despite McCabe’s good work history and guilty plea. He said McCabe must have known the grenade was going to be used for a violent purpose when he handled it.

Garda Alan Roche told prosecuting counsel Derek Cooney BL that the explosion caused extensive damage to the front of the building and the cars. He said the four occupants of the house were quite elderly and had lived there for most of their lives.

The next day a search of the area uncovered parts of the grenade, including the detonating lever and pin, and pieces of shrapnel.

The parts were analysed and it was found the bomb originated from the Yugoslavian army. DNA tests of the pin matched samples taken from McCabe and he was arrested.

He made no admissions in interview.

McCabe has 24 previous convictions including three for drug dealing and 17 for road traffic offences.

Defence counsel Michael O’Higgins SC said McCabe is related to one of the main culprits of the attack but that contact with this person has now been severed. He said McCabe has a good work history and is currently living with his girlfriend.

He asked Judge Nolan to be as lenient as possible and to note that McCabe has not been charged with throwing the grenade, only possessing it.

Balbriggan student avoids jail term after sexually assaulting 11-year-old girl

A student who sexually assaulted an 11-year old girl by squeezing her bottom and chasing her has received a three-year suspended sentence.

Daniel Edwards, 19, of Clonuske View, Balbriggan was 17 at the time of the offence.

The victim – who cannot be named – identified Edwards in a line-up.

Edwards had one previous conviction for a similar offence for which he had received a two-year suspended sentence in 2008.

Cormac Quinn BL, prosecuting, said the family of the victim were present at Dublin Circuit Criminal Court and submitted a victim impact statement.

He told the court that the accused was sitting on a wall outside a shop when he saw the girl cycling past and followed her.

Mr Quinn said Edwards asked the girl “Do you want to earn a fiver?” to which she replied “Go away”.

He then squeezed the girl’s bottom and said “Sexy” and chased her when she ran away, until she went into a friend’s house for safety.

The court heard that the girl, who is now aged 13, has been visiting a school counsellor about the assault and is going to continue to do this weekly.

Defence counsel Isobel Kennedy SC said that Edwards has finished his Leaving Cert and is now applying to colleges to study creative media courses.

She said Edwards has not been in trouble since this offence and is fully compliant with the terms of probation, signing on daily and attending a Northside Inter Agency Project, where he is said to be making “enormous progress”.

Ms Kennedy said Edwards experienced “shame and guilt” after the offence, that he has accepted full responsibility it and that he and has managed to rehabilitate himself, although she said this is “an ongoing process”.

Judge Patricia Ryan said the serious nature of the assault and the impact on the victim had to be taken in account for sentencing.

The judge also said that Edwards cannot approach the victim or her family, based on concerns expressed in the victim impact statement.

She imposed a three-year suspended sentence on strict conditions.

Chinese man to be sentenced for rape of Irish student

A Chinese man will be sentenced next week after he was caught by gardaí raping an Irish college student in a laneway.

The court heard that the woman had left her friends in a nightclub and was walking home when Hong Zhi Yang, 23, took her into the laneway and attempted to rape her.

A person living in a nearby flat, heard the woman’s screams, looked out the window and saw Yang attacking the victim. He told the man to get off her and contacted the gardaí.

Yang then dragged the woman further up the lane and raped her. Gardaí arrived on the scene minutes later and witnessed the attack. Yang tried to run away but was immediately caught by gardaí.

Detective Sergeant Paul Tallon agreed with a comment from Mr Justice Paul Carney that such a crime is “uncharacteristic of the Chinese community here”.

“Well I have never come across it before,” the Det Sgt said.

He said when gardaí arrived the victim was semi-naked, crying and huddled on the ground next to a parked car. Her clothes and jewellery were scattered along the laneway and she was initially too upset to talk to gardaí. She had small injuries to her face and back.

Yang of Camden Street, Dublin 2, pleaded guilty at the Central Criminal Court to raping the woman in the city centre on October 29, 2010. He has no previous convictions either here or in China and had arrived in Ireland to study English the previous August.

Det Sgt Tallon told John O’ Kelly SC, prosecuting that Yang and the woman were complete strangers but Yang claimed in interview that the sex had been consensual and that he loved the woman.

He told gardaí that he fled when they arrived on the scene because he had been having sex in a public place.

Det Sgt Tallon read the woman’s victim impact statement in which she said she found it really difficult to talk to people about what had happened and lost some close friends as a result.

She said it put “massive strain and pressure” on her relationship with her boyfriend and when she told her family about it she didn’t know how to put into words that she had been raped.

Det Sgt Tallon said the victim now needs to be “completely aware of her surroundings” and will no longer listen to music or read a book when she is travelling. She also had to defer her college exams.

Yang told Mr Justice Carney he had deep feelings of regret for what happened that night and was truly remorseful.

“I cannot express how ashamed I am. I can only hope that the woman can go on to live a life free from fear and anxiety,” Yang said before he apologised to the gardaí and everyone involved in the legal system.

His counsel Denis Vaughan Buckley SC, read a letter addressed to Mr Justice Carney in which Yang stated that he had ten drinks that night, while the most he had ever drank in China was one beer.

He said he was not offering this as an excuse but wanted the court to understand that his actions were out of character.

“I am sick to the stomach,” Yang wrote “I have never hurt a human being before.” He said he has brought dishonour to his family and great shame to his name.

“I know I cannot undo my mistake,” he said adding that he will return to China as soon as he served his prison sentence.

Yang’s sister said that her parents were in court to support their son and this trip was the first time they left China.

She apologised to the victim and her family and asked Mr Justice Carney for leniency.

She said her brother had come to Ireland to study English the August before the rape. She said he has since learned English and sat a leaving certificate maths exam while on remand in prison.

Mr Justice Carney remanded Yang in continuing custody and adjourned the case to next Monday for sentence.

€330,000 worth of drugs seized at Dublin Port

Customs officers have arrested one man after €330,000 worth of drugs where discovered in a 40ft trailer that arrived in to Dublin Port from Holyhead.

It is estimated that the drugs seized were 22kg of herbal cannabis  and 1kg of cocaine.

The man that has been arrested is in his 50s and is being held at Store Street garda station.
