The High Court has been asked to review a recent divorce action that was allegedly dealt with by a judge after just 50 minutes.
A solicitor for the woman said he was surprised and “in horror” when the decision was handed down because, in his view, the case was far from over.
The woman’s lawyers say a two-day divorce hearing was over in less than 50 minutes with a “surprise” ruling the next morning by Circuit Court Judge Martin Nolan.
They claim this amounted to unfair procedure as they had not called their own witnesses. They also claim they were cut short in their cross examination of the woman’s former husband.
Her solicitor has told the High Court they were unable to question her former husband about a bond he had bought partly from the proceeds of selling the family home in Dublin which went for close to €1m, or allegedly “strange” claims he made that his wife’s difficulties with alcohol had been a huge problem in the marriage.
It is also claimed that a marital reconciliation – which did not last – may mean the couple were not living apart for the four years required to allow the judge to grant a divorce.
